  12. To all amateur radio operators:

  14. Are you aware of a bill being proposed in the Ohio Legislature that would
  15. essentially prohibit the erection of 'communications towers' in residential
  16. areas in the state of Ohio?  I have received a copy of an as yet unintroduced 
  17. bill which would do exactly that.  The regulations in this bill will make it 
  18. nearly impossible (and very costly) for anyone to erect a tower more than 35 
  19. feet tall.

  21. The bill mandates public hearings before any tower may be constructed or site 
  22. aquired, and requires that any tower be located "at least 1000 feet from the 
  23. nearest existing residential use or district, including any planned district 
  24. wholly or partly for residential use, or from the nearest public park."
  25.  
  26. This bill will certainly be opposed by the Cellular Phone industry and, in
  27. all probability, the broadcast insustry.

  29. The only number I have for the bill is "LSC 119 0961."  It is twelve (12) 
  30. pages long (8.5 x 14" pages).  If you would like a copy, please contact me 
  31. (or your state representative).  I can probably provide copies in return 
  32. for a large (8.5 x 11") envelope with proper postage - check with me for 
  33. details.

  35. I'm sure Amateurs in Ohio should be fighting against this bill, or at least 
  36. lobbying for a blanket exemption for amateur radio towers.  While the appli-
  37. cation of this bill to amateur radio may eventually be overturned by PRB-1 
  38. [97.15(e)], it will cause a lot of trouble until somebody has the time and 
  39. money to challenge the State of Ohio in Federal Court.  It will be easier 
  40. to prevent the adoption of this bill than to fight it later.
